    On 30th March 2026, the Lok Sabha passed the Insolvency and Bankruptcy Code (Amendment) Bill, 2025 which was subsequently enforced on 6th April 2026. The Amendment Act of 2026 seeks to introduce reform measures to address practical challenges within the system and develop Indian insolvency law in line with global best practices. The amendment includes a host of measures aimed at reducing delays, strengthening creditor empowerment and creating a more investor-friendly framework.

    Real Estate Insolvency: Key Recommendations by Committee

    The Insolvency and Bankruptcy Board of India released the Report of the Committee on Framing Guidelines for Insolvency Proceedings in the Real Estate Sector, pursuant to directions of the Supreme Court of India in the case of Mansi Brar Fernandes v. Shubha Sharma & Ors., (December 12, 2025). The Court emphasized the need to prioritise project completion and protect homebuyer interests, consistent with broader constitutional principles, including the right to shelter under Article 21.

    IBBI Issues Revised Guidelines for IP Panel (January-June 2026)

    IBBI Proposes Reforms to Strengthen Insolvency Governance

    The Insolvency and Bankruptcy Board of India (IBBI) has released two notable discussion papers, namely, Minimum Shareholding Requirements for Directors and Partners of IPEs dated November 17, 2025, and Standardised Templates for Beneficial Ownership and Section 32A Affidavits dated November 6, 2025. Together, these papers propose substantive reforms intended to enhance governance discipline within Insolvency Professional Entities (IPEs) and improve the quality, uniformity, and reliability of disclosures in the Corporate Insolvency Resolution Process (CIRP).

    Personal Guarantors: IBBI Addresses Gaps in Insolvency Process

    Recent amendments notified by the Insolvency and Bankruptcy Board of India (IBBI) require resolution professionals, with creditors’ approval, to intimate the Adjudicating Authority of the non-submission of the repayment plan by personal guarantors.

    Accordingly, Regulation 17B has been introduced in the IBBI (Insolvency Resolution Process for Personal Guarantors to Corporate Debtors) Regulations, 2019.

    IBBI Proposes to Make Monitoring Committees Mandatory

    Income Tax Reassessment Notice Issued Post Approval of Resolution Plan Not Maintainable

    A recent ruling involved the petitioner challenging an income tax reassessment notice issued after the approval of a resolution plan by the National Company Law Tribunal (NCLT). The Hon’ble High Court of New Delhi in the case of Asian Colour Coated Ispat Limited v. Additional Commissioner of Income Tax and Ors.,(2024 SCC OnLine Del 5459), dated August 7, 2024, held that once a resolution plan is approved under the Insolvency and Bankruptcy Code (IBC), 2016, income tax reassessment for periods before the plan’s approval is impermissible.

    Certain Key Details to be Verified before Record of Default is Issued

    The amendments recently notified to the Insolvency and Bankruptcy Board of India (Information Utilities) Regulations, 2017, require the information utility to verify key details such as the e-mail address of the debtor, the document showing proof of debt, etc. before issuance of record of default.
